Premade Asset License Terms of ServicePurchase of my assets assumes that you have read and agreed to these Terms of Service.In these Terms of Service will be used "I", "me", "my" and "own" to refer to the creator of the asset and copyright owner of the intellectual property while "you", "licensee", "customer" will refer to potential and current holders of a respective asset license. "Third-parties" and "others" will refer to individuals and groups outside these Terms of service.If you disagree with these terms prior to purchase it is encouraged to refrain from purchasing from me.
These Terms of Service are non-negociable and shall changed without prior notice.1. Use of assets
1.1 Personal uses
Assets can be used for any personal use, such as in private passion projects and private display.
1.2 Individual commercial uses
An individual person may use my assets for limited commercial uses. Companies who want to use my assets commercially will have to discuss a full custom commercial license with me.
a) Allowed commercial uses
(i) Online Self promotion
(ii) Content creator posts, video thumbnails, banners
(iii) Merchandise related to the asset, digital or physical, eg. keychains, stickers
b) Disallowed commercial uses
(i) Print Publishing, book or magazine covers
(ii) Billboards
(iii) Physical product packaging unrelated to the asset, eg. food, skincare
1.3 Showcase of assets
For the safety of the intellectual property, it is required to protect your license by following these strategies:
a) Online: smaller resolution, watermarked and with my signature visible
b) Physical: full resolution, no watermark, with my signature visible2. Adjustments, editing and modification of assets
2.1 Edits made by Licensee
Any adjustment, edit, modification and alteration of the asset done by the licensee is permitted so long as is still recognizable.
2.2 Edits made by Third-parties
It is required to provide a written request of permission to me before attempting to request or commission a third party for any adjustments, edits, modifications or alterations to the asset.
2.3 Edits made by creator
For an additional cost, you can request of me an Asset Modification Commission to modify any desired asset I own to any extent you want with no limitations and full ownership rights provided, commercial rights can also be included, separate and distinct Terms of Service apply, inquire for further details.3. Porting of assets to unintended software
This section uses the terms "port" and "porting" as the act of taking assets intended for a specific piece of software and adapting them for a different one. Depending on the nature and prevalent use of the destination software to which you are porting the asset to, you may be permitted to do so conditionally.
3.1 To software intended for manual creation
Software intended for drawing, sculpting, modelling, game creation, photo or video editing are allowed.
Here is a list of software examples that are allowed to be used, however this list isn't exhaustive.
a) PNGtuber Plus, PNGtuber Remix, Veadotube, Honk
b) Photoshop, Procreate, Clipstudio, Aseprite, Krita
c) Blender, Maya, Z Brush
d) Premiere, Davinci Resolve, Kdenlive
e) Unity, Godot, Unreal, Gamemaker, Pico 8
3.2 To software intended for automated generation
Software intended to be or act as a Large Language Model, neural network, algorithm, automated generator, prompted personal assistant is disallowed to be used with my assets. Software made for trading of crypto, tokens, currency or digital goods and converting assets to such formats is also disallowed.
a) ChatGPT, Dall-e, Gemini, Claude, Sumo, Sora and alike
b) Open Sea and other NFT markets
c) Roblox, Second Life, IMVU, Everskies4. Credit and association with creator
4.1 Credit
The license is given with the expectation that the licensee will provide credit to the intellectual owner of the asset in question every time the asset is used. If credit cannot be reliably given in writing near the asset were is visible, then is expected to leave the signature visible or credit to be given in writing somewhere in relation to the project in question.
a) Merchandise: credit given in the description of the product, listing images or packaging
b) Webside: credit in the footer were you'd declare copyrights
c) Content creation: credit in the description of your account
d) Game: credit given in the "Credits" section
4.2 Association
By these Terms of Service, you, as the licensee, are associated with the intellectual owner of the asset in a business and professional manner. You are not required to declare this association outside the credits given as part of your license. Further association is allowed so long as you collaborate with me on the motives behind this settlement. I reserve the right to associatively distance myself from licensee should it affect my reputation, audience, business, craft, health or otherwise.5. Transfer of license
You are disallowed from transferring your license unto a third party, regardless of circumstance. If an individual or group wants to also be lent my assets, the current licensee is required to redirect them to me. Attempting to transfer any license I have granted under these Terms of Service will result in the termination of the license attempted to be transferred as well as other licenses you had.6. Grounds on which a license may be revoked
It is to be noted that the following potential reasons and measures are guidelines in the event these Terms of Service are breached. Should other measures be implemented if given the circumstance, I reserve the right to do so within reason.
6.1 Reasons
a) Misuse of asset
b) Lack of credit
c) Innapropriate behaviour towards creator, their craft or audience
d) Innapropriate or offensive edits of asset
6.2 Measures
a) written request to cease innapropriate use of asset
b) written request to provide credit were due
c) written request to revert innapropriate edits of the asset
d) if continued, written warning that the license will be terminated
e) public declaration of dissasociation with customer who's license got revoked
